Terms of Service

These Terms of Service (“Terms”) govern your access to and use of eaglebourbon.com (the “Site”) and the products and services offered by Eagle Bourbon (“Eagle Bourbon,” “we,” “us,” or “our”). By accessing the Site, creating an account, or placing an order, you agree to these Terms.

If you do not agree to these Terms, do not use the Site.

1. Eligibility and Alcohol Compliance

You must be 21 years of age or older (or the legal drinking age in your jurisdiction, whichever is higher) to access this Site and purchase alcohol.

By using the Site and placing an order, you represent and warrant that:

  • You are of legal drinking age.

  • You will comply with all applicable federal, state, and local laws related to the purchase, delivery, possession, and consumption of alcohol.

  • You are not purchasing alcohol for unlawful resale.

We may require age verification and may cancel or refuse any order if we cannot verify eligibility.

2. Shipping Restrictions and Delivery Requirements

Alcohol shipping is regulated and varies by location. We ship alcoholic beverages only where permitted by law. Some products may be restricted or unavailable depending on the delivery address.

Adult signature and ID may be required. Many shipments require a signature from a person 21+ with a valid government-issued photo ID at delivery. Deliveries will not be left unattended when an adult signature is required.

You are responsible for:

  • Providing a complete and accurate shipping address.

  • Ensuring a person 21+ is available to receive the shipment during delivery hours.

  • Any consequences of failed delivery due to recipient unavailability, incorrect address, refusal, or inability to provide valid ID.

We do not ship to P.O. boxes or addresses that carriers cannot deliver alcohol to.

3. Orders, Acceptance, and Cancellations

Placing an order is an offer to purchase. Orders are not final until accepted by us. We may refuse, cancel, or limit any order at our discretion, including due to:

  • Inventory issues, system errors, or pricing errors

  • Shipping restrictions or compliance concerns

  • Suspected fraud or unauthorized activity

  • Inability to verify age or delivery eligibility

If we cancel an order after payment is captured, we will issue a refund to the original payment method.

4. Product Information, Availability, and Errors

We aim to provide accurate product descriptions, pricing, and availability. However, errors can occur, including inventory discrepancies or system glitches.

We reserve the right to:

  • Correct any errors or omissions

  • Change product availability

  • Limit quantities

  • Discontinue products without notice

  • Cancel orders affected by errors

If an item is listed as in stock but is not available, we may offer a refund and, when possible, substitution options.

5. Pricing, Taxes, and Charges

Prices are listed in U.S. dollars unless otherwise stated. Prices, promotions, and availability may change without notice.

You are responsible for all applicable taxes, shipping charges, and fees shown at checkout. Your bank or card issuer may apply additional fees, which we do not control.

6. Payments

By providing payment information, you represent you are authorized to use the chosen payment method. We may use third-party payment processors. We do not store full payment card details on our servers when processed by a third-party provider.

7. Promotions and Promo Codes

Promo codes and promotions are subject to these Terms and any additional terms displayed with the offer. Unless stated otherwise:

  • Promo codes cannot be combined.

  • Promo codes have no cash value.

  • We may modify or end promotions at any time.

8. Returns, Refunds, Restocking, and Failed Deliveries

Because alcohol sales are regulated, returns may be limited. Unless required by law, all alcohol sales are final.

We will work with you to resolve issues such as:

  • Items damaged in transit

  • Incorrect items shipped

  • Missing items

Claims window: Please contact us within 48 hours of delivery (or first delivery attempt, if applicable) with photos of damage and packaging, when relevant.

Refund timing

If a refund is approved, it is returned to the original payment method. Depending on your bank, refunds typically take 3–5 business days to appear.

Returned-to-sender and failed delivery attempts

If a package is returned to us due to failed delivery attempts, refusal, incorrect address, or the recipient not being available to sign/verify ID:

  • We can reship the order for a $25 reshipment fee, or

  • We can process a refund minus a 10% restocking fee.

Shipping charges are generally non-refundable, unless required by law or the error was ours.

9. Pre-Orders and Backorders

Some items may be offered as pre-orders or may become backordered due to supplier or distribution delays. Estimated arrival dates are not guaranteed.

If a pre-order or backordered item is delayed, we may contact you with options, including waiting for fulfillment, substitution (with your approval), or cancellation and refund.

10. Risk of Loss

Risk of loss passes to you when the shipment is transferred to the carrier, to the extent permitted by law. We will assist with carrier claims when applicable, but we cannot guarantee carrier resolution.

11. Accounts and Site Use

If you create an account, you agree to provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. We may suspend or terminate accounts for suspected misuse or violations of these Terms.

12. Prohibited Conduct

You agree not to:

  • Use the Site for unlawful purposes

  • Misrepresent your age or identity

  • Attempt to bypass age verification or delivery requirements

  • Interfere with the Site’s security or operation

  • Copy, scrape, or misuse Site content without permission

13. Intellectual Property

All content on the Site, including text, images, logos, and design, is owned by or licensed to Eagle Bourbon and is protected by applicable intellectual property laws. You may not use our content without written permission.

14. Third-Party Links

The Site may contain links to third-party websites. We do not control and are not responsible for their content, policies, or practices.

15. Disclaimer of Warranties

To the maximum extent permitted by law, the Site and products are provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

16. Limitation of Liability

To the maximum extent permitted by law, Eagle Bourbon will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from or related to your use of the Site or purchase of products.

Our total liability for any claim will not exceed the amount you paid for the applicable order giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless Eagle Bourbon and its owners, employees, and affiliates from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising from your violation of these Terms or misuse of the Site.

18. Privacy

Your use of the Site is also governed by our Privacy Policy. If you have not posted a Privacy Policy yet, you should do so before accepting orders.

19. Changes to These Terms

We may update these Terms from time to time. The Effective Date above reflects the most recent version. Continued use of the Site after changes means you accept the updated Terms.

20. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought in the state or federal courts located in San Diego County, California, and you consent to jurisdiction and venue in those courts.
